Both databases are on the same server, what are the risks I should look out for... I know this is not an orthodox thing to do, so please give informative comments if you have any.

Correction..."not on the same server"
Going from lower RU to higher is not a huge deal. First time you start up the AOS and log in, you will be prompted with an "upgrade checklist", as it detects the database.
Consider that when you installed RU8 the same thing happened. The database was RU5, you install the update - then when you start up, the db is RU5 but the binaries RU8.

So you're saying that after I restore de DB with the information from the old instance, into the server with the new instance... after I restart the AOS and log in is that the point when I will be prompted with the upgrade check list... again? as if I was doing the RU8 installation again or is it a different process to bring the RU5 DB into the RU8?
It's basically like doing the upgrade again (the data upgrade anyway). The database contains the version of the application it belongs to. AX 2009 stores the application in the AOD files, including the application version. So when you first start up, it will detect that the database application version and the code application versions are different, and present you with the upgrade checklist.
