After the market close on September 17, 2008, the SEC issued Release No. 34-58572, Emergency Order Pursuant To Section 12(k)(2) of the Securities Exchange Act of 1934 Taking Temporary Action to Respond to Market Developments, to prevent ?sudden and excessive fluctuations of securities prices and disruption in the functioning of the securities markets that could threaten fair and orderly markets.?
The release is the latest of several steps the SEC has taken to clamp down on naked short selling. Regulators said they are worried about the extent to which such trades affect all public companies and not just the financial institutions that were the protected in the July emergency order in Release No. 34-58166.
In the release, the SEC said it is adding temporary Rule 204T to Regulation SHO, effective immediately.
