Licensing and SLAs

Whilst starting a new project, we considered using the Microsoft SLA functionality but found it didn't fit the requirements. Fine - code something custom to fit the custom requirements.

However, I am told that implementing SLA-like functionality still requires you to purchase the more expensive SLA licenses. So I do not use the MS functionality, go through all the effort of writing something custom, but have to pay more money anyway.

1) Is this correct?

2) Who judges whether something is SLA-like? How do I tell if something I build falls foul of this rule?
