I am finding it a little weird where on running the reports:
sometimes the (data and layout) option appear and 
sometimes it doesn't appear like this:
 
is there any explaination regarding this?

    Word layouts don’t support exporting both Data and Layout, whereas RDLC and Excel layouts do. This would explain why you’re seeing the option appear inconsistently. Since you mentioned it's a custom Word layout, that's likely the reason it's behaving differently across companies.

    Yes i do agree with @YUN ZHU sir that the Report Layout is RDLC then the data and layout format Option will be there. In case of Word Report Layout it will not be available.

    This is very simple, the first picture is a rdlc type layout, and the second one should be a word layout.
    For example,

    Hello all, 
    yes it is a customed word layout, well i thought this was the problem until I tried another company has the same report word layout and it works normal.
    It is weird for real.

    I think it has to do with the type of layout used for the report; Word layouts don't support the option of exporting Data and Layout to Excel file, while RDLC and Excel layouts do. So those reports built with Word will have Data only.
     
    Nevertheless I'm not 100% sure this is the reason, I'm answering based a bit on my experience. Maybe you can check it out on the reports you used for the screenshots?
