Dutch VAT and US sales tax in a single company - sales tax receivable

Is it possible to register both VAT and sales tax in a single company in Ax 2012. For an US organization I am asked to setup a warehouse in the Netherlands, the warehouse will have it's own Dutch VAT registration number but is not a separate legal entity. CIT will be done in the US. 

The goods are shipped from the US warehouse to the Dutch Warehouse, at the Dutch customs office the VAT needs to be paid over the imported goods.

My idea was to have a separate tax group (NL), Item tax group (Import), and tax code (NL-Import) for the import tax. Register the import tax as invoice in an invoice journal and manually set the tax rate to 100% (invoice amount 1000, actual sales tax amount 1000). However with the Apply U.S. taxation rules in General ledger parameters checked this transaction is not posted to the correct ledger account and is not part of the Tax report generated with the sales tax payment. Expected result would be 1000 on the sales tax receivable account, but this cannot be setup with the Apply US taxation rules parameter set.

Right now we are thinking of setting up a separate company just for the Dutch warehouse. This feel like a bit of an overkill for such a basic requirement.

Am I missing something in the setup options which allows me to be able to register the Dutch VAT which needs to be paid over the customs value of the goods?

    Hi André, Also my apologies to you for my late reaction. Using just a ledger account is currently our leading idea. We are thinking of using the auto charge functionality to have a charge, with a percentage set, automatically posted on the purchase orders. To the charge code we can connect the ledger account we wish to use for VAT.

    You are correct in your assumption. The Dutch VAT declaration can and in this case will be filled in manually. So we just need to create a report which collects the correct information.

    Hi Remco,

    Have you considered NOT using the Tax setup for the Dutch VAT, but only a ledger account? Probably the balance of that NL VAT Receivalbe account can be used to make the declaration. I assume you could enter the amounts on the Dutch declaration application manually; not using the Dutch electronic reporting from within AX. Also I do think to understand you only have to report on one sales tax reporting code.

    Thank you for your response. Currently we are not making any transactions. The warehouse is not in use yet.

    We would like to use the purchase invoice journal for the registration of the 100% VAT invoice, however if there is a better solution I am always open for suggestions.

    The expected transaction would be:

    Supplier Dutch Tax Authorities

    Ledger account

    Accounts Payable             1000

    NL VAT Receivable 1000

    Tax direction: Sales tax receivable

    With the Apply US taxation rules parameter setup the 100% sales tax is posted to a expense account since the tax receivable account cannot be setup in the Ledger posting groups.

    Hi Crispin,

    Thank you for responding. The shipping will be done with Incoterm CIF so the import VAT can be registered on the Dutch VAT number. How we will register the shipment in Ax is not known yet, this will depend on the solution which we are currently designing.

    From the setup point of view the new company is the easiest solution. However for the maintenance one company would be the hoped-for solution. Having to maintain customers and products in two companies means twice the work.

    Hi Remco,

    The US taxation rules and the Dutch Sales tax are indeed not compatible within the same legal entity.

    However, depending on the transactions you need to post, it can be done differently. In your question I read you need to register 100% sales tax. What account is used now and what account (types) were expected? Are you posting (general) journals? In that case check if you filled three! sales tax fields: Sales tax group, Item sales tax group and also Tax code.
