our businesspartner for NAV told us, that an period of notice for the service plan of MS exist.. in last years i don't read/hear about this.. we wouldn't pay for the old versions (NAV 5.0)

You can check with MS about the possibilities of buying new license with limited users.
If they Microsoft allows, you can terminate the old one and get into new contract.
I am not sure, if MS would allow the same. However it depends on the negotiation that you do with them.

we want to install the new version (NAV 2016) and working with a new license - the old license of volume too large - so we will terminate the old contract.
You need to pay BREP (16% of your license cost) every year, so that you can be eligible for the latest version of NAV.
If you have not paid so far, you will not be able to migration your existing NAV 5.0 version to latest NAV version. Also you can not buy new users licenses.

If you talk about BREP (Business Ready Enhancement Plan), it is an annual subscription fee (~16% of the total licenses and additional objects costs) that is paid on a regular basis. First time it is paid when you purchase the licenses/objects immediately, and is valid for one year. Then, you have an option to continue this subscription by paying another 16% annual fee. For that, you can have access to CustomerSource, use latest updates and training materials, purchase additional objects and download newer versions for upgrades.
Normally, you obtain the license from a Microsoft partner. Partners are very interested to sell both licenses and BREPs as this is the only real measurement of their achievements for Microsoft. Thus, partners themselves are interested to notify you when a new period should start - in advance, and ensure you are paying it.
However you should be aware of the fact that Microsoft is not supporting old versions of NAV. Normally, only the latest 2-3 versions are supported (e.g., hotfixes and legal updates are issued officially). Version 5.0 is no more supported, as well as 2009.
If you had paid your annual subscription fee for 5.0 version till today, you have a good option to upgrade for current version without additional licensing costs of fines. (Here I should mention that the licensing policy per user also changed, and your current users will be converted to new users on a certain principle, valid for your country and agreements with partner and vendor).
If you had not paid the subscription fee for your 5.0 version for many years, it means that you need to pay a huge fine to cover this non-payment if you want to buy additional objects or make upgrade to new version. In most cases, it means that it might be more reasonable to skip using current licenses and buy new ones from scratch - it can be less expensive than paying the fines for old licenses.
