Upgrading Dynamics CRM 365(Originally 2016) on-Prem from 8.2.28 to 9 - Action Pack License

We currently have Dynamics 365 CRM 8.2.28 up and running on a Windows 2016 server. The license is a workgroup license from the Microsoft Action Pack. It was originally installed as Dynamics 2016 and one of the updates changed the name to 365, not sure which one but it was early on. Now we see that Version 9 is available. Is there a new license required for this update? We contacted the Microsoft Partner group with the Action pack support and they told us that all they license is 2016 and that is the most current but we all know that isnt the case. I am wondering if I apply the 9 installer will it do an upgrade or will it ask for a new license? Is there a better contact at Microsoft that may know? They dont seem to know much.

After going through all the details and other posts I seem you need to have a go through a planned and organized migration. I think there are some bits and pieces which are missing.
