I'm a freelance consultant/programmer that wants to start working with AX. I would like to get the 2012 VM, can I cat access with an action pack subscription?

If you have a MSDN subscription (might be included in an action pack), you can have access to Dynamics AX setup files only. You have to install and setup the system yourself. But that will be very hard without proper knowledge.
Only partners/customers with access to Partnersource or Customersource do have access to virtual machines.

As André say, from MSDN you can download only the installation files.
However, I think these files aren't available on Action Pack subscription.
