Microsoft orphaned customers. Contingency plan in case of NAV Vendor business disruption

Dear all

My company is about to implement NAV and, not sure about the financial stability of our vendor, we need to understand what contingency plan MS can offer in case the vendor, in this case a MS Gold partner, will go into administration before we go live.

We heard about Microsoft Orphaned Program that should manage the transition towards another partner and, by accessing source code and implementation documents (analysis, design etc...) would start from where the previous vendor left.

My Questions:

Is there a Microsoft formal process in the unlikely event of vendor bankruptcy?

Has anyone dealt with MS orphaned customer department?

    Technically, you can easily transfer yourself from one partner to another: you just sign and apply one simple form telling Microsoft that you are now need to be assigned to the other partner. The new partner will take care of your license and customer care questions. So you will not be totally without a partner, and this transfer is at no cost.

    However you should not expect that the new partner will finalize your initial project for free, as well as Microsoft would not sponsor anyhow your implementation project. Thus, if you already had paid in advance to your existing partner and he will not provide you what he owes to provide, you will loose your money and you will need to pay to a new partner the price you would negotiate with him (open market competition).

    Another issue that you might face is that your existing partner had made many customizations and had not left any documentation on that. Or, even worse, he protected part of the code so it would be very difficult to finalize such development (however, not impossible).

    We already managed to agree on costs of implementation. These will be paid on a T&C basis so we only pay what is delivered.

    Implementation will be fully documented and the source code of any customization will be available.

    Hopefully this will help mitigating the effects of a bankruptcy

    Good, in this case I do not see major showstoppers in case of the bankruptcy of the partner (however it is always a pity thing). In some cases, if you liked the end consultants, you can have direct freelance contract with them in case they will loose their current jobs.
