Enterprise portal Gridview showing a row on empty

I have added a gridview attached to a datasource. This all comes from a NCR form that is the main piece to where my custom webpart is created from. Everything pulls up fine. Shows the data, saves, deletes, inserts all dandy. With NCRid's that have no tasks or dispotions section(s). already entered is basically auto inserts a blank row(picture below). I don't need it to insert anthing until they hit the add on the toolbar. What could be causing this. I have to code that inserts data. It's all built in to the axgridview that is tied to that dataset.
