Marketing forms overwriting consent

Interesting problem we have. We have a bunch of event sign ups where we also ask people top opt-in to Topics at the bottom.

A lot of our sign ups know they already receive marketing emails from us (and are happy to!) so they don't check the box.

However this seems to be opting them out of the topic instead of ignoring.

Is there a setting or option to prevent this?

    this is a problem i am also facing. As you describe when a topic checkbox is added to the form and not checked, it will opt contacts out, eventhough they have already opted in before. There is no option to prevent this, unless you remove the checkbox from the form and ask the contacts who have not opted in yet seperately.
