Data protection isn't enabled

Hi everyone, I have a quick question. We're currently switching from outbound to real-time marketing. I see a yellow push notification in the "Feature Switches" workspace:

Data protection isn't enabled, which means that the consent levels recommended here won't be enforced. Please remember that it's your organization's responsibility to conform to all data protection regulations (such as the GDPR) in the countries/regions where you run marketing activities. To enable data protection, go to the Data protection tools.

Is this still a notification from outbound marketing, or do I need to consider it for real-time marketing as well? Isn't this the same as consent management? We're based in Germany.

Thank you for your support! Best, Victoria

Good morning, afternoon, or evening :) depending on your location!
    Hope you are well today.

This notification is relevant for real-time marketing and not just outbound marketing. Here's a breakdown to clarify:
    Understanding the Notification:
    1. Data Protection in Real-Time Marketing:
      • Real-time marketing includes features like consent management to ensure compliance with data protection regulations such as GDPR.
      • The notification is a reminder that data protection tools need to be enabled to enforce consent levels and manage customer data responsibly.
    2. Consent Management vs. Data Protection:
      • Consent Management is a subset of data protection. It ensures that you collect, store, and process customer data only with their explicit consent.
      • Data Protection encompasses broader responsibilities, including securing data, managing consent, and adhering to regulations like GDPR.
    3. Why This Matters in Germany:
      • As you're based in Germany, GDPR compliance is critical. Enabling data protection tools ensures that your marketing activities align with GDPR requirements, such as obtaining explicit consent and providing opt-out options.
    Next Steps:
    • Enable Data Protection Tools:
      • Navigate to the "Data Protection Tools" section in Dynamics 365 and enable the necessary settings.
      • This will activate features like consent enforcement and data tracking.
    • Review GDPR Compliance:
      • Ensure that your real-time marketing campaigns adhere to GDPR principles, including transparency, purpose limitation, and data minimization.
      • For more details, you can refer to this guide on GDPR compliance in marketing.
    • Educate Your Team:
      • Train your marketing team on the importance of data protection and how to use the tools effectively.

    Hope this helps!

    Hello Victoria,

That yellow push notification in the "Feature Switches" workspace is absolutely relevant to Real-Time Marketing (RTM) and is not just a leftover from Outbound Marketing. You need to pay close attention to this, especially since you are based in Germany and subject to GDPR.

    Let's break down why:

    • Data Protection and GDPR are Crucial for RTM: Just like Outbound Marketing, Real-Time Marketing handles personal data for marketing activities. Therefore, adhering to data protection regulations like GDPR is paramount.
    • Consent Management in RTM: While RTM has its own consent model that is more granular and built for real-time interactions (consent points, topics, purposes), the underlying principle of obtaining and respecting consent remains the same as under GDPR.
    • The "Data protection tools" Setting: This setting within Dynamics 365 Marketing (which encompasses both Outbound and Real-Time) controls the enforcement of the consent levels you configure. If data protection isn't enabled, the system won't automatically block marketing activities based on insufficient consent.
    • Recommended Consent Levels: The notification explicitly mentions that the "consent levels recommended here won't be enforced." This implies that you might be configuring consent levels within RTM (or even still have Outbound consent settings), but without enabling the "Data protection" feature, the system won't actively prevent sending emails or engaging in other marketing activities with contacts who haven't provided the necessary consent.
    • Organization's Responsibility: The notification correctly states that it's your organization's responsibility to comply with data protection regulations. Enabling the "Data protection tools" is a crucial step in leveraging the system's built-in capabilities to aid in this compliance.

    •

Why you need to consider it for Real-Time Marketing:

    • GDPR Applicability: As a company based in Germany, you are directly subject to the General Data Protection Regulation (GDPR). This regulation has strict requirements for obtaining and managing consent for processing personal data, including for marketing purposes.
    • Enforcement of Consent: Without enabling the "Data protection tools," you risk sending marketing communications to individuals who haven't explicitly consented to receive them, which would be a direct violation of GDPR.
    • Granular Consent in RTM: While RTM offers more granular consent options, these options are only effective in ensuring compliance if the "Data protection tools" are enabled to enforce them.

    •

In summary, you absolutely need to consider this notification for Real-Time Marketing. It's a critical setting that ensures your configured consent levels are actually enforced by the system, helping you comply with GDPR.

    Your Next Steps:

    1. Navigate to "Data protection tools": Click on the link provided in the notification to access the data protection settings within Dynamics 365 Marketing.
    2. Enable Data Protection: Follow the instructions in the "Data protection tools" to enable this feature. You might need to configure specific settings related to your organization's data protection policies.
    3. Review Consent Configuration: Ensure you have correctly configured your consent levels and purposes within Real-Time Marketing (and Outbound if you still have active elements or data there).
    4. Consult Legal Counsel: It's always recommended to consult with your legal counsel specializing in GDPR to ensure your overall marketing practices and system configurations are fully compliant.

    5.

Ignoring this notification could lead to significant GDPR violations and associated penalties. Treat it as a high-priority task during your transition to Real-Time Marketing.
